The Community Right to Bid allows defined community groups to ask the Council to list certain assets as being of ‘community value’. The Localism Act (2011) and the Assets of Community Value Regulations (2012) set out the opportunities and procedures to follow for communities wishing to identify assets of community value and have them listed. If an asset is listed and then comes up for sale, the new right gives communities six months to raise finance and put together a bid to buy it.  Local Authorities have a specific role in the process:

  • to decide on asset listing;
  • to ensure asset owners understand the consequences of listing;
  • to enforce the moratorium period;
  • to take decisions as part of any appeals process.

The Government has previously published a non-statutory advice note for local authorities on GOV.UK.

Decision reviews

There have been to date three requests to review decisions we have made to include assets on the list:

Gladiator Club

The owner of the Gladiator Club requested that we hold an internal review into our decision to list the Gladiator Club as an asset of community value. This review was carried out by David Edwards, Executive Director, City Regeneration. The decision to list the Gladiator Club as an asset was upheld.

Kassam Stadium

The landowner of the Kassam Stadium requested that we hold an internal review into our decision to list the Kassam Stadium as an Asset of Community Value. This was an oral hearing, at the landowner's request. The review was carried out by David Edwards, Executive Director, City Regeneration. The decision to list the Kassam Stadium as an asset was upheld. The landowner then requested a review at the First-tier Tribunal. The Judge agreed that the Kassam Stadium should be included in our list of assets of community value.

Temple Cowley United Reformed Church

The freehold owner of the Temple Cowley United Reformed Church requested that we hold an internal review into our decision to list the Temple Cowley URC as an Asset of Community.  The review was carried out by David Edwards, Executive Director, Regeneration and Housing. The decision to list the Temple Cowley United Reformed Church as an asset was upheld.
