A certain amount of noise is normal in most types of construction and building operations, which can rarely be completely prevented. However, noise from construction sites can be very disturbing.
Acceptable times for noisy work
Generally, acceptable hours for noisy work are considered as:
- Monday to Friday, 7.30am to 5.30pm
- Saturdays, 7.30am to 1pm
- Sundays and bank holidays, no noisy work will normally be permitted
Exceptions
We may agree for work to happen outside these times if:
- a developer can show us they can't carry them out at these times and they are taking steps to keep noise to a minimum
- the work is of an emergency nature and has to be done as soon as possible, such as a burst water main
- the work is on a main road taking place outside peak times to avoid congestion
What action we can take
We can serve a notice imposing requirements as to how construction works should be carried out so as to minimise noise and disturbance.
Failure to comply with the notice can lead to a fine of up to £20,000.
Prior consent
It is preferable that contractors apply for prior consent from us rather than face the prospect of a notice being served after they have commenced work, the effect of which may seriously interfere with their planned work programme.
Contractors planning to undertake construction and demolition work can consult us before proceeding, and through making an application for prior consent can ask them to make their requirements known
